Terms of Service

Effective Date: January 2025. Please read these terms carefully before using Kradlr.

1. Agreement to Terms

By accessing and using Kradlr (“Service”), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.

2. Use License & Commercial Use

Permission is granted to download and use materials (information or software) on Kradlr’s website and within the Kradlr app for personal and commercial purposes related to your use of the Service. This is the grant of a license, not a transfer of title. Under this license you may not:


  • Reproduce, duplicate, copy, or sell Kradlr materials or content

  • Redistribute, resell, or commercially exploit Kradlr’s content or software outside the Kradlr platform

  • Reverse engineer, decompile, disassemble, or extract code from the Service

  • Scrape, harvest, or bulk download data from Kradlr’s systems

  • Transmit or redistribute Kradlr’s materials in any medium without explicit written permission

  • Remove, obscure, or alter any copyright, trademark, or proprietary notices

  • Transfer, license, or sublicense the Service to third parties

  • Use Kradlr to build, train, or develop competing products or services

  • White-label or rebrand Kradlr’s Service for resale

2a. Intellectual Property Ownership

All content, features, functionality, design, graphics, code, and materials that comprise the Kradlr Service, including but not limited to software, databases, documentation, and AI models, remain the exclusive property of Kradlr and its licensors. You acknowledge that no title to the intellectual property in the Service or materials is transferred to you. You retain all rights to data you input into Kradlr, but grant Kradlr a license to use, process, and analyze that data to provide and improve the Service.

2b. Commercial Use Restrictions

While you may use Kradlr for legitimate commercial purposes within your own business, the following are prohibited:


  • Using Kradlr to create a competing lead generation or AI communication platform

  • Reselling Kradlr’s services or features as your own product

  • Allowing unauthorized third parties to access your Kradlr account for their commercial benefit

  • Aggregating or combining Kradlr data with other data sources for resale or redistribution

  • Extracting Kradlr’s technology, methodologies, or processes for use in competing services

3. Disclaimer of Warranties

The materials on Kradlr’s website are provided on an ‘as is’ basis. Kradlr makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Important: Limitation of Liability

KRADLR SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF REVENUE, LOST BUSINESS, LOST PROFITS, LOST LEADS, BUSINESS INTERRUPTION, LOSS OF DATA, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF, OR INABILITY TO USE, THE MATERIALS OR SERVICES, EVEN IF KRADLR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

4. Business Risks & System Performance

You acknowledge that Kradlr provides an AI-powered service subject to inherent risks and uncertainties. Specifically, Kradlr does not guarantee and shall not be liable for:

Lead Quality or Conversion: No guarantee that the Service will capture, qualify, convert, or result in any leads, sales, meetings, or revenue

Lost Revenue or Leads: Any lost revenue, missed business opportunities, lost leads, or failed conversions resulting from the Service or its performance

System Downtime: Unexpected service interruptions, downtime, bugs, errors, or system failures, whether planned or unplanned

AI Errors or Behavior: Any errors, inaccuracies, or unintended behavior of the AI agent, including misquotations, miscommunications, or inappropriate responses to leads

Integration Failures: Failures in third-party integrations with CRM systems, lead sources, calendars, or other external platforms

Data Loss: Loss of data, transcripts, or records due to system failures, data corruption, or force majeure events

Regulatory or Legal Issues: Any legal, compliance, or regulatory issues arising from the use of the Service

Competitive Impact: The competitive disadvantage of not using the Service or changes in market conditions

5. Service Availability

While Kradlr strives to maintain 99% uptime, the Service is provided on an “as-available” basis. We do not warrant that:


  • The Service will meet your specific requirements

  • The Service will be uninterrupted, timely, secure, or error-free

  • Any defects in the Service will be corrected

  • The results obtained from the Service will be accurate or reliable

6. AI Agent Behavior & Responsibility

You understand that the AI agent may occasionally make errors, provide inaccurate information, or behave in unintended ways. Kradlr is not responsible for:


  • Miscommunications or misrepresentations made by the AI agent to leads

  • Failure to respond to leads in a timely manner

  • Quality of conversations or lead qualification

  • Compliance with lead-handling best practices or disclosure of AI involvement

It is your responsibility to monitor AI interactions and ensure compliance with all applicable laws, regulations, and ethical guidelines regarding lead engagement.

7. Trial Period & Setup Fees

All new accounts are eligible for a 30-day free trial. Custom integrations or advanced setup services may incur a separate setup fee, which will be disclosed before any charges are applied. No credit card is required to start your trial.

8. Billing & Cancellation

After your trial period ends, you will be charged according to the plan you select. You can cancel your account at any time. Cancellations take effect at the end of your current billing cycle. No refunds are provided for partial months.

9. Limitation of Liability

In no event shall Kradlr be liable to you for damages of any kind (including, but not limited to, special, indirect, incidental, or consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from your use of or inability to use the Service, whether based on warranty, contract, tort (including negligence), strict liability or any other legal theory, and whether or not Kradlr has been informed of the possibility of such damage.

Liability Cap

Except where prohibited by law, the total liability of Kradlr under these Terms shall not exceed the amount paid by you for the Service in the 12 months preceding the incident.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kradlr and its officers, directors, employees, agents, and suppliers from any and all claims, damages, losses, or costs (including reasonable attorneys’ fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of any third party.

11. Third-Party Services & Integrations

The Service may integrate with third-party services (CRMs, lead sources, phone systems, etc.). Kradlr is not responsible for the availability, accuracy, or performance of any third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

12. Modifications to Terms

Kradlr reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service following any modification constitutes your acceptance of the new Terms.

13. Modifications to Service

Kradlr reserves the right to modify or discontinue the Service (or any part thereof) with or without notice. Kradlr shall not be liable to you or any third party should we exercise this right. Any new features that augment or enhance the current Service shall be subject to the Terms, unless otherwise specified.

14. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Kradlr is incorporated, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

15. Severability

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

  • Right to Correct inaccurate personal information.

  • Right to Opt-Out of the sale or sharing of your personal information, including sharing for cross-context behavioral advertising.

  • Right to Limit the Use and Disclosure of Sensitive Personal Information to what is necessary to provide the services.

  • Right to Data Portability and the Right to Non-Discrimination for exercising any of these rights.

To opt out, you may use the “Do Not Sell or Share My Personal Information” and “Limit the Use of My Sensitive Personal Information” controls where offered, or contact us using the details below. We also honor opt-out preference signals such as the Global Privacy Control (GPC). California’s “Shine the Light” law (Civil Code §1798.83) further allows California residents to request information about disclosures of personal information to third parties for their direct marketing purposes. We will respond to verifiable requests within 45 days, with an extension where permitted.

Texas Privacy Rights (TDPSA)

If you are a Texas resident, the Texas Data Privacy and Security Act gives you the right to:

  • Delete personal data provided by or obtained about you.

  • Obtain a portable copy of the personal data you previously provided.

We do not sell sensitive personal data or biometric data; if our practices ever change, we will post the notices required by Texas law (for example, “NOTICE: We may sell your sensitive personal data.” or “NOTICE: We may sell your biometric personal data.”). We recognize universal opt-out mechanisms such as the Global Privacy Control. You may appeal a refusal to act on your request, and we will respond to your appeal within 60 days; if we deny the appeal, we will provide a method to contact the Texas Attorney General.

Florida Privacy Rights (FDBR)

Sensitive Information & Opt-Out Preference Signals

We do not sell or share sensitive personal information, and we use any sensitive information only as necessary to provide the services you request or as otherwise permitted by law. We do not use or disclose sensitive personal information for purposes that require the right to limit. Where required, we recognize browser- and device-based opt-out preference signals, including the Global Privacy Control (GPC); when we detect such a signal, we treat it as a valid request to opt out of the sale or sharing of personal information and processing for targeted advertising for that browser or device.

Exercising Your Rights & Appeals
